The Head of State received the Chairperson of the Constitutional Court Elvira Azimova, El.kz reports citing Akorda.
She reported on the activities of the supreme body of constitutional control.
The President was informed that over the past year the Constitutional Court received more than 5,000 appeals, 99% of which were from citizens.
According to Elvira Azimova, in their appeals, citizens raised questions about judicial acts, the legality of the actions of officials and judges, the types and conditions of criminal punishment, the observance of human rights in the framework of criminal prosecution, the protection of rights in labor and administrative legal relations.
The main approach of all states in which constitutional courts operate is not to restrict citizens' access to constitutional justice and to eliminate financial barriers. In this regard, in December 2023, the Head of State signed a law providing for the reduction of the state duty for applying to the Constitutional Court to a zero rate.
Kassym-Jomart Tokayev was informed that the Majilis of the Parliament is currently considering proposals on the conditions for providing citizens with guaranteed legal assistance within the framework of constitutional proceedings, as well as taking into account the decisions of the Constitutional Court and reviewing judicial practice in the framework of legal monitoring and rule-making.
The Head of State was also provided with information that last year 558 norms of law were checked, based on the results of the inspections, it was recommended to amend 29 legal acts. The Constitutional Court has made recommendations on the revision of certain provisions of the Criminal Procedure Code, the Tax Code and a number of laws. At present, the Government and authorized bodies have implemented more than 16% of the recommendations.
The President stressed that the results of the work of the Constitutional Court for 2023 showed that its creation and activities meet the needs of society and the state to ensure the supremacy of the Constitution of the Republic of Kazakhstan and protect human and civil rights and freedoms.
